Each year, millions of individuals file claims against insurance companies to recover after an accident or incident. In some cases, filing a claim against the liable party’s insurance company is sufficient to cover your damages. However, when you or your loved one’s injuries are significant, filing a standard insurance claim will not cover all of your damages. There are also added concerns when individuals do not obtain the coverage required under the law. When individuals fail to comply with the law or insurance policies limit your right to relief, you will want to speak with an experienced attorney to determine your options. For a risk-free initial consultation, contact Sanford A. Kassel Law, APLC today. Our attorneys will be happy to help you determine your rights to relief.
Liability After an Accident
California tort law follows a comparative negligence standard when determining liability after an accident or incident. In these cases, the fault of each party is compared to determine the amount of recovery an individual can obtain after an accident or incident. California uses a pure comparative negligence standard. Comparative negligence allows a victim to recover only for any damages they did not cause. For example, two individuals are partially responsible for an accident. The accident caused $20,000 in damages to Party A’s vehicle. Party A is 30% responsible and Party B is 70% responsible. If Party A files a claim against Party B, the individual will recover 70% of the damages.
Underinsured and Uninsured Drivers
Although California law requires all motorists to obtain certain minimum amounts of coverage to ensure that coverage is available when an accident or incident occurs, it is not guaranteed that there will be any or sufficient insurance coverage to cover your claim. Despite the law, motorists operate vehicles each day without any accident coverage. In addition, some motorists do not have enough coverage to satisfy a claim. When these types of incidents occur, you have options to ensure that you still obtain more relief by filing a claim against your own insurance policy.
In California you have the opportunity to obtain underinsured and uninsured motorists coverage. If you have been involved in an accident or incident, this type of coverage may be available if you purchased this optional plan.
