Discrimination in the workplace is an unfortunate, but common, occurrence. Many individuals who believe they are being subject to discrimination become frustrated and attempt to resolve the issue as quickly as possible by finding other employment. However, when discrimination in the workplace occurs and searching for other employment does not seem feasible, there are options for individuals who are being discriminated against in ways that violate the law. Anti-Discrimination Laws

Both federal and state laws were created to prevent discrimination in the workplace based on certain classifications which are protected. Originally, federal law was created to protect discrimination in the workplace. It included limited classifications to protect individuals. Over time, federal laws were expanded to offer more protections. In addition, states also began creating laws to protect individuals in the workplace. However, some states including the state of California offer greater protections and include things like marital status, military status, and more. The most common federal laws protecting individuals from discrimination in the workplace include:

Civil Rights Act of 1964: Title VII of the Civil Rights Act prohibits discrimination on the basis of race, color, religion, and national origin.

Age Discrimination in Employment Act (ADEA): The ADEA prohibits employment discrimination on the basis of age. This act applies to individuals who are 40 years of age or older.

Americans with Disabilities Act (ADA): The ADA prohibits discrimination against individuals with disabilities. This act protects individuals with disabilities from discrimination practices that apply in hiring, interviews, testing, and accommodations.

Identifying and Addressing Discrimination

Identifying discrimination in the workplace is sometimes difficult as there is often the presence of unfair treatment in offices that does not amount to discriminatory practices covered under the law. When discriminatory practices are made in such a way that are open and obvious, it is much easier to identify and state a claim. However, many cases of discrimination against protected classes are not open and direct. If you or a loved one suspects that you are being discriminated against based on being part of a protected class, it is best to speak with an experienced attorney who will help you determine your next steps.

If discrimination is actively occurring in the workplace, you should follow all internal policies and procedures for reporting any incidents that form a basis of your beliefs about the discrimination.
