Understanding CFRA Leave of Absence for Designated Persons

At Sanford A. Kassel, A Professional Law Corporation, we specialize in representing employees in employment law matters, including leave of absence under the California Family Rights Act (CFRA). This article will discuss the amended provision under Government Code Section 12945.2(b)(5)(B) that regulates leave of absence for “designated persons” in the San Bernardino Riverside Inland Empire region.

What is the CFRA?

The California Family Rights Act (CFRA) is a state law that provides eligible employees with the right to take a leave of absence for specific family and medical reasons. This includes leave to care for a family member with a serious health condition.

Understanding Government Code Section 12945.2(b)(5)(B)

Effective January 1, 2023, Government Code Section 12945.2(b)(5)(B) has been amended to expand the scope of CFRA leave. Employees may now take a leave of absence when medically necessary for the serious health condition of a “designated person” in order to care for them.

A “designated person” is defined as an individual identified by the employee at the time the employee requests CFRA leave. The employee is entitled to designate only one person for whom the employee may take leave to provide care during any particular 12-month period.

Implications for Employees in San Bernardino Riverside Inland Empire

This amendment underscores the importance of supporting employees in their caregiving responsibilities, even if the individual they are caring for does not fall under the traditional definition of “family.” If you are an employee in the San Bernardino Riverside Inland Empire region and need to take a leave of absence to care for a designated person with a serious health condition, you are entitled to do so under CFRA.
